Attempt on DFO’s life
9/26/2006 10:11:43 PM

Jammu, Sep 26 : Special Municipal Mobile Magistrate Jammu Sanjay Parihar has granted absolute bail to three persons facing trial for alleged attempt to murder of a DFO, who is said to be the prime witnesses of an infamous timber smuggling scam. The accused were already granted interim bail by the court till today.
The bail application, moved by Karan Singh son of Thakur Mohar Singh, Pawan Gupta son of Baldev Raj and Sachin Bakshi son of RK Bakshi, was decided earlier on the last date of hearing and the accused were enlarged on interim bail. However, the court today after hearing both the sides and going through the Case Diary granted absolute bail to the accused subject to conditions laid down in the order.
Karan Singh, Pawan Gupta and Sachin Bakshi were taken in custody by the police on September 8, 2006 in case FIR NO. 100/06 under sections 307/34/109/120B RPC, which was registered on the basis of complaint filed by one Vijay Gupta, Retired DFO who reported to the police that on September 4, accused at the behest of accused Kuldeep Singh and Mushtaq Ahmed Choudhary intercepted the complainant and caused severe injuries upon his body.
As per the police, the accused were arrested and weapon of offence was recovered from their possession. Kuldeep Singh, who was on an anticipatory bail, also surrendered before the court pleading a false and frivolous case has been registered against him.
The accused Kuldeep Singh also placed a certificate issued by Superintendent GMC on the record wherein it was claimed that no persons with the name Vijay Gupta was ever admitted in the hospital.
The court observed that the certificate puts and question mark on the prosecution story. “Since no recovery is to be effected from the accused and he has shown his readiness to cooperate with the investigation in my view no purpose would be served in forwarding the accused Kuldeep Singh to judicial or police custody”, observed the court.
