Bhim challenges Uadhampur LS polls

Jammu, June 29- Prof. Bhim Singh, Chairman Jammu and Kashmir National Panthers Party, who unsuccessfully contested election from Udhampur Parliamentary constituency, filed election petition in the J&K High Court under Article 329 of Indian Constitution today being the last date to file such petition.
Prof Singh has challenged election of Congress MP on several grounds which include the corrupt practice, manipulation of the EVMs (Electronic Voting Machines) and on legal grounds.
In this petition, Prof Singh has alleged that the Returning Officer, the Deputy Commissioner of Kathua, had illegally, unconstitutionally and improperly accepted the nomination forms of Congress and BJP candidates which were not filled in all respects as
was required under Election Commission’s letter No.56/2009/PPS-II dated 14th January, 2009 addressed to the National and State parties. In the documented proof it has been established that the nomination papers of the Congress candidate were without mentioning any date and the Form-B of Congress candidate was illegally endorsed by someone (not named) who claimed to be President of J&K Pradesh (I) Committee, Jammu. The petition states that there is no J&K Pradesh Congress (I) Committee in existence nor there was no any authority vested in it by Indian National Congress. Similarly, the Form- A of Dr. Nirmal Singh was dated nil and could not have been accepted because it was not filled in all respects. It also says that Dr. Nirmal Singh didn’t subscribe to oath according to the procedure and failed to mention his gender in his oath besides it didn’t say whether he has taken oath in the name of God or he/she solemnly affirmed.
The Election petition seeks declaration from the High Court the election of Congress MP as void so that fresh election could be held for the Udhampur Lok Sabha constituency to enable the electorates to elect their representative in the Parliament of India without fear.
