| HC dismisses petition challenging renewal of license of Video Hall | | | Early Times Report Jammu, June 29- Justice Virender Singh of J&K High Court Jammu Wing today dismissed a petition challenging the legality and validity of order March 3, 2008 on the basis of which the license in favour of video hall was renewed by the District Magistrate Rajouri. Pronouncing the judgment on behalf of Justice Virender Singh, Justice Mansoor Ahmed Mir observed that the court is of the view that the instant petition merits dismissal as the petitioner cannot enforce any right, much less legal right, through the medium of this petition especially at this stage when the earlier license which was renewed in favour of Kamal Kant Gupta of Video Hall Rajouri up to March 31, 2009 has already out-lived its life, may be still operational up to the end of this month on the strength of two orders passed by this court on different occasion. Grant of license is recommendatory in nature and it is a recurring cause of action. It has its limited life span. It can be even suspended in between by the concerned authority, if certain violations are noticed by it. Justice Virender Singh while dismissing the petition further observed that even if in the flash back of the previous events the petitioner is apprehensive that the official respondent may help the private respondent for renewing license once again for the next year 2009-2010 still the petitioner cannot ask for the relief of such a nature in anticipation. The Court was of the considered view that the petitioner has no case at all and the petition is dismissed. THE Court also took serious note that the petitioner has not averred in the petition with regard to the previous civil litigation going on between him and the private respondent. Taking a lenient view in this regard the Court did not impose any cost upon him. JNF
