| One year jail term for Defence Accounts official | | | Early Times Report Jammu, June 30- Special Judge Anticorruption Jammu BL Bhat today awarded one year’s rigorous imprisonment and fine of Rs 30,000 to Raj Kumar, the then senior Auditor, in the office of Principal Controller of Defence Accounts Northern Command, Satwari Jammu, in a corruption case. The accused was caught red-handed by CBI team on May 15, 2001 while accepting Rs 15000 from the complainant for releasing amount more than 18 lakhs in favour of the complainant. Special Judge, after hearing senior Public Prosecutor SK Bhat for CBI and Advocate P N Raina appearing for the accused, observed that accused is held guilty of offences under section 161 RPC and 5(2) read with section 5(1) (d) J&K PC Act SVT 2006 and is accordingly convicted. Taking serious notice of the crime committed by a member of the Defence, the Court observed that it was unfortunate that an establishment connected with a prestigious institution making supreme sacrifices for the country is involved in corruption practices. May be the case of convict is a solitary instance the convict deserves punishment commensurate with the level of his guilt. In the circumstances of the case Court find it just to awarded rigorous imprisonment of one year on each count and fine Rs 30,000 for offence u/s 5(2) PC Act 2006 and ordered that all the substances sentences shall run concurrently. One Rajneesh Gupta lodged a written complaint with the CBI (ACB) Jammu alleging therein that accused Raj Kumar senior auditor was demanding illegal gratification of Rs 15000 for clearance of the bills. Complainant further alleged that accused had threatened that unless 1% commission of the total bill was paid to him as illegal gratification none of the future bills of the complainant will be passed for payment. On this complaint, a case was registered and trap team was constituted by the CBI which laid a trap and caught the accused red-handed while accepting bribe. Subsequently house search of accused at Village Chakroi Tehsil RS Pura was conducted and Rs 12. 86 lakh in the shape of cash, KVP and cash certificates were recovered for which a separate case was registered. The charge was framed against the accused by the Court.
