Court acquits five of family members who set on fire residential kulla

Jammu, July 04- Principal Sessions Judge Jammu SS Sarangal acquitted five members of a family facing trial for the last six years for allegedly setting ablaze residential Khulla on March 27, 2003 belonging to complainant Mulkh Raj resident of Mawa Brahmana.
The accused including Ram son of Mangi, Taro Devi wife of Sansaro Ram, Ashok Kumar son of Sansaro Ram, Veena Devi wife of Ashok Kumar and Gusha Ram son of Sansaro Ram allegedly, with common intention, set the residential kulla on fire belonging to Mulkh Raj.
In acquittal judgment Principal Sessions Judge, after hearing Public Prosecutor EA Tak appearing for the State and Advocate Surinder Kour appearing for the accused persons, observed that in the present case almost all the witnesses examined by the prosecution are interested witnesses and the only independent witness examined by the prosecution has not supported the prosecution case and there is no other independent witness to support the prosecution version. The Court further observed that the prosecution has not been able to prove the guilt of the accused persons beyond any reasonable doubt and as such the benefit of doubt is given to the accused persons and they are acquitted of the charges leveled against them.
According to the prosecution story on March 28, 2003 complainant Mulkh Raj resident of Mawa Brahamana lodged a verbal report with the police station Akhnoor alleging therein that accused had an old enmity with the complainant regarding a piece of land. On March 27, 2003 at about 5 PM all these accused with common intention set his residential Kulla on fire, with the result all the articles lying in kulla got burnt down. On this report an FIR was registered against the accused persons and investigation was started. After completion of the investigation challan u/s 436/34 RPC was presented in the Court of law which was dismissed and the accused acquitted from the charges leveled against them. JNF
