Challenging transfers not matter of right

New Delhi, July 8: The Central Administrative Tribunal (CAT) has said that a government employee cannot claim transfer to a place of his choice as a matter of right.
The bench, comprising Chairman V K Bali and Vice Chairman L K Joshi, passed the order on a plea filed by a 1994 batch Indian Revenue Service (IRS) officer, challenging the Centre's direction to transfer him to Gujarat.
The Officer, Rajeev Kumar, working on deputation as an Additional Commissioner in the revenue department pleaded that like other colleagues, he should be given posting in Delhi.
"Under the rules, an IRS (official) is bound to serve anywhere in the country. He cannot claim a posting to Delhi as a matter of right. We are unable to fathom the cause of his angst at not being posted to Delhi," the CAT said.
The tribunal rejected the contentions of the official, who alleged that his transfer was in violation of the policy of the government. "The argument that his transfer is in violation of the transfer policy does not hold good," the tribunal said.
