| Court awards 2 yrs RI to driver after 10 yrs of investigation trial | | | EARLY TIMES REPORT JAMMU, JULY, 9: Chief Judicial Magistrate Jammu YP Bourney awarded two years rigorous imprisonment and fine Rs 5000/- to Rajeev Kumar who on November 15, 1999 while driving tractor rashly and negligently hit a scooty driven by Rajni Kour an employee of the Jet Airways at the main gate of Air-Port as a result of she received serious injuries and later succumbed to her injuries while being shifted to hospital. A case u/s 304-A and 279 RPC was registered and Challan was presented the in the Court of CJM Jammu. CJM Jammu after hearing CPO Pawan Khajuria with PO Kuldeep Bhat appearing for the state said that the evidence on record clearly established the commission of offence u/s 279/304-A RPC by the accused for which he was charged. He is convicted accordingly for the said offences. As regard punishment he has shown no regrets for his conduct though these are the first offences committed by him and is a young man of 28 years. All these factors dissuade the Court from granting him the benefit of probation of offenders Act. He is in the given circumstances sentenced to undergo rigorous imprisonment for three months for offence u/s 279 RPC and to undergo rigorous imprisonment for two years and also to pay fine of Rs 5000/- for the offence u/s 304-A RPC.
