| Man accused of throwing acid on his Divorced wife denied bail | | | Jammu, Sep 27 : Municipal Magistrate Jammu Sanjay Parihar has rejected bail plea of one Avtar Singh who is behind bars from last more than four months for allegedly throwing acid on the face of her divorced wife at Bakshi Nagar, Jammu. Dismissing the bail application moved by the accused through his counsel Advocate PS Pawar, the court observed that the crime perpetuated by the accused is grave and by the act the accused has destroyed the future of his divorced wife as the acid has not only caused damage to her face but it has also snatched her sight of her left eye. Taking serious view of the fact that the material placed on record shows that the accused has even no mercy for his wife, who lived in his company for more than five years before they go separated by mutual divorce in Feb 2006, the court observed that the accused does not deserve the concession of bail. “It is certainly true that the bail is not to be refused as a mark of punishment but in the given circumstances the court has to act with care so that such acts are not repeated”, the court observed, while denying the bail to the accused. The accused is facing trail for commission of offence under Section 326/201 RPC. As per the case registered against him, the accused sprinkled chemical like substance over the face of his divorced wife at Bakshi Nagar, on May 18, 2006. The accused alleged called her from the behind and than suddenly threw acid on her face due to which the woman suffered corneal injury on her left eye. The accused moved the bail application with the plea that the accused is behind bars since 19-5-2006 and has an old age mother, who has no one to take care of. However, the application was resisted by the prosecution on the ground that the accused has committed an offence which is not only against the prosecutrix but against the whole society. After going through the case file the court observed that the chemical used by the accused is said to be hydrochloride acid and its use has resulted in the loss of eyesight to the victim. |
