Court stays selection trial notice of suspended JKCA official
9/27/2006 5:58:46 PM

Srinagar, Sep 27 A local court here stayed a public notice issued by a suspended General Secretary of the Jammu and Kashmir Cricket Association (JKCA) inviting cricketers for selection of the state team for the under-22 C K Naidu trophy.

The second additional munsif stayed the operation of the notice issued by suspended JKCA General Secretary Saleem Ahmed Khan on September 23, informing the cricketers that open trials for selection of the state team for the C K Naidu trophy and other tournaments would be held at the Sher-i-Kashmir Cricket Stadium here from September 29 to October 8, till his interim application was considered by the court.

The judge passed the orders yesterday on a motion for staying the operation of the notice filed by the JKCA chairman in which he stated that Mr Khan had been placed under suspension following a resolution of July 18.

Mr Khan later challenged his suspension in the court of second additional munsif and the petition was pending disposal.

No orders have been passed in this regard so far and it has become imperative at this stage to preserve the list and also to enable the JKCA to conduct trials for under-22 tournaments as per the notification issued on September 12, the judge said.

He said till date the suspension of Mr Khan has not been either revoked, modified or stayed by any competent authority.

Therefore, the suspended JKCA General Secretary has no statutory authority to issue any notice regarding the selection trials or otherwise, the judge ordered.

He said as such the notice issued by Mr Khan on September 23 has no sanctity in the court of law.

However, the judge said the order was subject to objections by the suspended JKCA General Secretary who is at liberty to apply for modifications, variance, reversal or discharge of this order even before the next date of hearing in the case on October 8.
