| Petition against CCBL dismissed | | | Early Times Report Jammu, July-18: Second Additional District Judge Jammu Vinod Chatterji Koul today dismissed a petition filed by one Subash Chander a share-holder of Citizen Cooperative Bank Limited seeking direction for restraining board of directors from taking any policy decision for the operation of the working of citizen cooperative bank and holding any Annual General Meeting of the share-holders of the bank. Second Additional District Judge Jammu Vinod Chatterji Koul after hearing Advocate K S Johal appearing for the petitioner, Advocate Sanjay Kakkar appearing for the Chairman CC Bank ltd and Advocate Abhinav Sharma appearing for the Bank, after considering the points raised in the petition observed that section 175 of the cooperative societies Act creates a bar regarding the jurisdiction of the Civil Courts in regard to any dispute referred to Registrar (Cooperative Societies) u/s 70 of the Act. In view of the provisions of section 70, the provisions as contained in section 9 cannot be exercised in this case, the petition u/s 9 of arbitration and conciliation Act in view of the provisions as contained u/s 70, 71 and 72 as 175 of the Cooperative Societies Act, which is accordingly dismissed.
