| Court granted bail to alleged killer of mother | | |
Jammu, September, 27:- Principal Sessions Judge Jammu Mr. Subhash Chander Gupta today granted bail to Davinder Singh s/o Tirath Singh and Narinder Singh s/o Amar Singh residents of Karan Bagh, Gadi-Garh Jammu, who are facing trial in alleged committing murder of mother of accused Davinder Singh.
The accused have moved the bail application for grant of bail through Advocate Sunil Sethi with Advocate Vishal Kapur on the ground that prosecution case is based upon the circumstantial evidence of last seen together with the deceased, who happens to be the mother of accused Davinder Singh. The prosecution has examined almost all the witnesses and they have not connected the accused persons with the crime in any manner, even the brothers of the deceased who were arrayed as prosecution witnesses have not stated anything against the accused. The accused are in custody, though they have not committed any offence. On the other hand Public Prosecutor Mr. EA Tak opposed the release of both the accused on the ground that the accused committed a heinous offence which is punishable with imprisonment of life or death and there is every possibility after release on bail, they tempered with the prosecution evidence.
Principal Sessions Judge Jammu Mr. Subhash Chander Gupta after hearing Advocate Sunil Seth and Advocate Vishal Kapur appearing for the accused persons and PP Mr. EA Tak appearing for the state and also gone through the main file and observed that admiotetdly the accused are facing trail in a heinous crime and the entire case of the prosecution hinges on circumstantial evidence and all the important witnesses have been examined. Before this bail application, earlier bail application was dismissed by this Court vide order dated May 9, 2006 by observing that statements of prosecution witnesses Zorawar Singh, real brother of the deceased Kirpal Kour, Jagbir Sing real brother of the husband of the deceased and Krishan Parshad to whom the deceased used to say about the quarrel picked up by her son Davinder Singh and she used to say that she will not allow to sell the property during her life and Teja Singh were not recorded at the time of dismissal of the said bail application. But now statements of all these four witnesses have been recorded and out of these witness three have been declared hostile by the prosecution and have been given up. Court also perused the statement of Zorawar Singh and other witnesses recorded in the Court. Court said that a case for bail is made out by the accused so far tempering of evidence is concerned all the material witnesses have been examined as such Court granted bail to accused on their furnishing surety bond and personal bond to the tune of Rs 50,000 each with certain directions.
According to the police case Devinder Singh accused s/o deceased with other accused Narinder Singh committed the murder of his mother after waking her up from the sleep and taking her away in the field caused injuries on the head of the deceased who succumbed to the injuries. According to the police the accused wants to sell the house which the deceased not allowed him.
