Court sentenced two accused facing trail in attack on woman

Kathua, September, 28:- Judicial Magistrate Kathua Mr. Sunil Sangra convicted and sentenced Dillo and Ashoku both r/o Barnoti Tehsil Kathua, who are facing trail for the last eight years in a case attacking and injuring complainant to undergo six months imprisonment u/s 323 RPC and also imposed fine of Rs 500/- each. The accused persons who were present in the Court were sent District Jail Kathua for serving imprisonment.



According to the prosecution story one Bimla Devi lodged a complaint with the police station Kathua in which she stated that on May 20, 1998, her son Manjit Kumar had gone to field for irrigation and she was also collecting vegetables in the field. When she was coming from the field in the way she saw accused persons have beating his son, she made an attempt to save her son, accused gave kick on her back and leg started beating her, she received injuries. The accused ran away from the spot. The police registered a case u/s 323 RPC against the accused persons and after completion of the investigation presented Challan in the Court of law.



Judicial Magistrate Kathua Mr. Sunil Sangra after hearing Prosecuting Officer Anil Dev Singh appearing for the State and Advocate Arvind Gupta appearing for the accused persons observed that considering of facts and circumstances of the case, Court is of the view that complainant as successfully established the contents of the complaint lodged against accused, which establishes that accused persons have committed offence u/s 323 RPC. With these observations Court on September 26, 2006 awarded sentence to the accused persons and sent them to the District jail Kathua for serving punishment.
