| Bhim challenges Lal Singh’s election | | HC issues notice to Congress MP, RO Udhampur PC On Bhim Singh’s Election Petition | | EARLY TIMES REPORT JAMMU, JULY 27: Justice Sunil Hali of J&K High Court issued notice to Congress MP, Ch. Lal Singh and Returning Officer, Udhampur Parliamentary Constituency on an Election Petition of Prof. Bhim Singh, who was a candidate from Udhampur Parliamentary Constituency in the 2009 election. Prof. Bhim Singh in his petition has alleged corrupt practice by the Congress and BJP candidates besides corrupt practice by the Returning Officer on several accounts. The Panthers Party candidate who lost election to the Congress candidate has averred that the Congress candidate was sponsored by Jammu and Kashmir Congress Committee (I) which is a non-existent party and has no legal bearing. He also accused the Returning Officer for accepting the nomination forms of Congress and BJP candidates which were not filled in ‘all respects’ which was mandatory under rules and the laws of nominations. The PP candidate claimed that he was the most acceptable candidate by the electorates till the counting date. He said the nomination forms sponsored by Central leadership of BJP and Congress didn’t bear the dates and place of sponsorship which makes the nomination form an illegal documents. Acceptance of the illegal documents by the Returning Officer amounted to corrupt practice according to the Representation of the People Act, the petition stated. The Panthers Party candidate accused the Congress candidate for conniving with the Returning Officer to replace the ballot boxes (EVMs) and even recharging the ‘SIMS’ with different programs in order to work out clear victory for the Congress candidate who was no where near the contest throughout the campaign. Prof. Bhim Singh has sought that election to Udhampur Parliamentary Constituency should be declared void and fresh election should be ordered forthwith.
