| HC issues notices as sharma challenges assembly election of Rashpal in Kalakote | | | Early Times Report Jammu, July 29- In a petition filed by an independent candidate Ashok Sharma challenging the election of NC candidate Rashpal Singh, Justice Nisar Ahmed Kakru of Jammu and Kashmir High Court Jammu Wing today issued notice for filling objections within a week. In the election petition filed through Advocate Ch. Vidya Sagar the petitioner Ashok Sharma ex-MLA of Kalakote has challenged the election of NC candidate Rashpal Singh on various grounds. The petitioner submitted that the elected NC candidate on the date of filling of the nomination papers as also on the date of scrutiny and even on the date of election was holding a contract with the state government through Excise Department and a huge amount was outstanding against him which was payable to the Excise Department. In the said contract a forgery and fraud was allegedly committed by the said respondent and a case was registered u/s 409, 420, 467, 468, 471, 120-B RPC against him under FIR No 8/96 of Police Crime Branch Jammu in which he was declared as absconder. This act of the respondent attracts disqualification under section 24-C of J&K Representation of Peoples Act 1957, the petitioner submitted in the petition. In the petition it has further been alleged that a group of firms and group of some individual received a loan from citizen cooperative bank limited branch Moti Bazaar Jammu in the year 1995 in which Rashpal Singh was one of the partners at the time of scrutiny, on the date of filling of nomination papers. On the date of election, huge balance in loans running into lakhs of rupees was outstanding against him and others which was recoverable from them on the said relevant dates in which award had been passed by the Registrar Cooperative Society. In this way under the provisions of J&K Representative of Public Act 1997 and the rules made there under disqualification of said respondent was attracted. Besides, these grounds and other grounds the petitioner sought the relief to declare the result of Rashpal Singh as void which was based on corrupt practices. JNF
