| HC directs JKPCC to regularize petitioner | | | Early Times Report Jammu, Aug 02- Coming to the rescue of a daily wager who was appointed as a daily rated worker in JKPCC who was appointed way back in 1992, Justice Sunil Hali of Jammu and Kashmir High Court Jammu Wing has directed the KPCC to regularize the services of the petitioner under SRO 64 of 1994 along with consequential benefits to which he would be entitled to and directed to complete this exercise within a period of three months. This significant judgment was passed in a petition filed by Hans Raj claiming to have been appointed as Daily Rated Worker in J&K Projects Construction Corporation Ltd (A J&K Govt. Undertaking) with effect from June 1, 1992 which is confirmed by the tentative seniority list of consolidated/ daily wages workers issued by the corporation. The grievance of the petitioner is that despite having completed seven years of service in the department he has not been regularized while as the Corporation regularized the services of 59 such workers who were junior to the petitioner. Justice Hali, after hearing the Advocate SK Puri appearing for the petitioner, observed that respondents have not chosen to file objections despite various opportunities granted to them. In absence of the objections, the contention raised by the counsel for the petitioner stands un-rebutted. The matter related to the year 2003 and the grievances of the petitioner is regarding regularization of the services. The persons junior to the petitioners stand already regularized as reflected from the order dated June 1, 2002. The petitioner is otherwise eligible to be regularized after completion of seven years of service under SRO 64 of 1994. With these observations Court allowed the petition and directed the respondents to regularize the services of the petitioner. JNF
