| Sessions Court rejected bail of Matador driver involved in killing seven persons and injured several persons | | |
Jammu, September, 28:- First Additional Sessions Judge Jammu Mr. GK Pandita today rejected the bail application of Pushpinder Singh s/o Hira Singh, who was involved in a two accident case in which seven innocent persons were killed and several injured by the rash and negligence driving of the accused. Mr. GK Pandita after hearing Advocate Rajinder Jamwal appearing for the petitioner and Additional Public Prosecutor Harpal Singh appearing for the state observed that it is admitted fact that the petitioner/accused had applied for bail before the CJM, Jammu; The CJM declined the bail to the accused. Another bail petition as been moved in this Court for grant of bail, it is manifest from the record that no patent change in circumstances, the petition has occurred in between, nor could the same be expected where the allegations against the accused are as mentioned. It is true that successive are not barred but it is equally true that Court dealing with subsequent bail petition must have something different to say in case it decides to grant bail. No change in the circumstances has been brought in the notice of the Court after rejection of the earlier bail application by the CJM Jammu. In view of the nature of the allegations against the accused and the public cry against the alleged act, there is likelihood of the accused running away and jumping over the bail. As such in such situation, the proper course is not to enlarge the accused on bail at this stage. Court is of the opinion that the concession of bail cannot be given to the accused at this stage and the bail application is accordingly dismissed. The allegation against the accused is that he drove the vehicle in high speed with rashness and negligence, this resulted in first accident which took place near Digiana Camp and in the said accident two pedestrians were killed. The accused instead of stopping the vehicle over there and enquiring about the welfare of those, who run over by the vehicle driven by him, drove away the vehicle from the spot at still higher speed and on wrong side of the road, on reaching near Digiana Ashram seven more persons were run over by the said vehicle out of which 5 persons died and two are struggling for their lives. |
