Murder Case decided within one and half year
Court acquitted accused as prosecution failed to prove its case

Jammu, September, 28:- Principal Sessions Judge Udhampur Mr. Kartar Singh acquitted Makhan Lal s/o Gandarb Chand r/o Muttal and Ravi Verma s/o Bindravan r/o Dhanu Tehsil Udhampur, who were facing trail in a murder case of Sarpanch Kuldeep Singh, which was occurred on February 28, 2005.



In the acquittal judgment Principal Sessions Judge Udhampur Mr. Kartar Singh after hearing Public Prosecutor Mr. GR Khajuria appearing for the state and Advocate appearing for the accused persons observed that the prosecution has produced more than 30 witnesses in which seven witnesses according to the prosecution were eye-witnesses but none of the witness supported the prosecution story. Investigating Officer Inspector Rajinder Kumar Bhardwaj has proved that a document prepared by him, his statement is not sufficient to prove the guilt of the accused. The material relied on the prosecution to fasten the guilt on the accused. It is held that same fall below the standard required to be achieved by the prosecution agency to demand conviction. The accused are acquitted from charges farmed against them.



According to the police case that on the fateful day, there was choubarsi of the father of Purshtom and the deceased Kuldeep Singh Sarpanch of Village Barnai had gone there, they took meal together and thereafter they left for their homes. It was alleged that Kuldeep Singh was killed by the accused persons while he was going to his home. It was further alleged that accused fired on deceased and thereafter attacked with sharp-edge weapon and deceased was admitted in the hospital where he succumbed to his injuries. The police after completion of the investigation presented Challan in the Court on May 18, 2005, Court decided the murder case in shortest period and acquitted the accused persons as prosecution failed to connect the accused with the crime.
