| Cement purchase scam | | Anticorruption Court frames charges against then BDO, Ors | | Early Times Report Jammu, Aug 8- Special Judge Anticorruption Jammu BL Bhat today framed corruption charges against then Block Development Officer Lohi Malhar of District Kathua, Cashier-cum-clerk Cooperative Marketing Society Mandli and plantation watcher in cement scam. CPO Purshtom Sharma appearing for the VOJ submitted that in the month of October, 2002 Tirloki Nath then BDO Lohi Malhar hatched a criminal conspiracy with co-accused Ranjana Gupta then Cashier-cum-clerk Cooperative Marketing Mandli and Mani Ram then Plantation Watcher in the office BDO with the object of committing misappropriation of public funds by procuring cement for execution of various works on exorbitant rates. Allegedly accused BDO placed a supply order for purchase of 900 bags of ACC cement 23 grade with Cooperative Marketing Society Mandli. Accused Ranjana Gupta then Cashier-cum-clerk of the society obtained five proforma bills dated November 6, 2002 from cement dealer M/S Chajju Ram & Sons and provided the same duly stamped and signed by her to accused BDO. In terms of these bills supply of 900 bags of ACC Cement was to be made to BDO Billawar against a total amount of Rs 1, 87, 254 @ 206 per cement bag including the commission to be charged by the society. Allegedly accused BDO contacted Shub Karan Shopkeeper of Dayalachak through accused Mani Ram and Bishan Dutt resident of Billawar for supply of 900 bags ACE brand cement on credit basis. The said shop-keeper obtained 900 bags of ACE brand cement from Amar Cement Factor Kathua and supplied the same to accused BDO, co-accused Mani Ram made fake stock entries in all five proforma bills earlier issued by the co-accused Ranjana capacity of Manager of Society. Showing that 900 bags ACC brand cement had been received in the store, on the basis of such fake entries accused BDO passed the five proforma bills resulting in drawl of Rs 1, 87, 254 from Government treasury on November 12, 2002, thereafter accused BDO after drawing amount from the treasury made payment of Rs 1, 37, 250 only in cash to Shub Karan shopkeeper through accused Mani Ram this resulting misappropriation of Rs 50,000. Aafter completion of the investigation VOJ presented challan in the Court. The Special Judge Anticorruption, after hearing CPO Mr. Purshotam Sharma appearing for the VOJ, Advocate SC Sharma appearing for BDO, Advocate Raghubir Singh appearing for cashier-cum-clerk and Advocate KS Charak appearing for the plantation watcher, framed charges u/s 5(1) (e) r/w 5(2) PC Act 2006 and U/Ss 409, 468, 471, 201 and 120-B RPC against the accused.
