| Javed Rana challenges Rafiq’s election from Mendhar constituency | | HC issues fresh notice to respondent | | Early Times Report Jammu, August-11- In an election petition filed by Javid Ahmed Rana, NC candidate from Mendhar, challenging the election of Rafiq Hussain Khan PDP candidate, the Jammu and Kashmir High Court today issued fresh notice to the respondent. After considering the note of Registry Justice Sunil Hali observed that notice has alreadys been issued to respondents N0 2, 6 to 12 but have not been received back even after the expiry of statutory period. Despite service they were not present as such they are set ex-parte, Court ordered. Regarding the notice issued to respondent No 3 through Munsiff Mendhar it was revealed that the said respondent was not available at home as such fresh notice be issued to respondent NO 3 and the same be pasted at the outer door of house of the respondent. The Court directed the counsel for the petitioner that he shall provide fresh particulars of respondent No 5 within a period of one week, thereafter notice shall be issued to the respondent No 5 The petitioner challenged Rafiq Khan’s election on several grounds and alleged that about 884 bogus votes were polled in favour of Khan. He further submitted that even the votes of the deceased were polled by impersonation while others were in foreign countries like Canada and Pakistan and prayed that the election of the respondent be declared void and the petitioner declared as having been elected from the said constituency.
