| Another Quarter-Century Trial | | Ex-Custodian EP acquitted in assets case | | Early Times Report Jammu, Aug11- Special Judge Anticorruption Jammu BL Bhat today acquitted the then Custodian Evacuee Property Jammu Haji Abdul Majid, who was facing investigation and trial for the last 24 years for possessing assets disproportionate to his known source of income. In his acquittal order the Special Judge observed that on appreciation of evidence brought on record during trial it transpires that the assets raised from known sources of income of accused and his family are far below the income figure. The accused has satisfactorily explained the income from legitimate sources and expenditure incurred on raising of assets. Margin of income is comparatively higher than the expenditure incurred on raising of assets. This has been a case of wrong calculation, overlooking of legitimate income from agriculture and attributing of certain expenditure like investment on purchase of scooter and cost incurred on construction of shop to accused without any basis. No case of holding assets disproportionate to known source of income against is made out. The case of accordingly dismissed and accused is acquitted of the charges framed against him. With his acquittal the Vigilance Organization has received a major set back. The Vigilance Organization started preliminary enquiry in the month of May 1986 and registered a case in the year 1990 and after completion of the investigation presented challan against the alleged accused in the Court in the year 1996. The accused was charged possessing assets disproportionate to his known source of income to the extent of Rs 1, 61, 000 which the VO failed to explain. JNF
