Accused facing trial in murder case gets 3 yrs RI

Udhampur, Aug 12-In an attempt to murder, the Principal Sessions Judge Udhampur JR Kotwal, today awarded three years rigorous imprisonment and fine Rs 10,000 to Ravi Kumar son of Chandu Ram resident of village Rathian. Out of Rs. 10, 000 fine, if paid, Rs 8,000 shall be paid to the injured Bishember Dass as compensation, the Court ordered.
After hearing both the sides, Principal Sessions Judge observed that accused Ravi Kumar having been found guilty, has been convicted for offence punishable u/s 341 and 307 RPC. On the question of sentence, Court further observed that the offence u/s 307 RPC is punishable with imprisonment for a term which may extend to 10 years and fine. However, if hurt is caused to any person by the act of the offender, as in this case, the punishment may be imprisonment for life as well. Thus the convict is sentenced to undergo rigorous imprisonment for a period of three years and to pay a fine of Rs 10,000 u/s 307 RPC. The Court further ordered that out of the fine Rs 8000 shall be paid to injured Bishamber Dass as compensation. JNF
Acting on a complaint of Lalita Devi wife of Bishamber Dass alleging therein that the accused persons namely Ravi Kumar, Ravinder Kumar and Kuldeep Kumar sons of Chandu on February 27, 2004 attacked her husband and inflicted blows with a toka in his abdomen and also took away Rs.10, 000 from his pocket, the Police registered a case u/s 307/341/34 RPC and 4/ 25 Arms Act. During the course of investigation it was found that a case u/s 294 RPC against accused Ravi Kumar was pending in the Court of law and accused was compelling the injured to withdraw the same and due to that accused was nourishing animosity against the injured. Having failed in making the injured to agree for the settlement of that case, accused Ravi Kumar made up his mind to liquidate him along with his brothers. JNF
