| Court acquits accused after 5 yrs of investigation, trial in murder case | | | Early Times Report Jammu, Aug 14: Acquitting Multan Singh from the charges of committing murder of Daryodhan Singh, after five years of investigation and trial, the Principal Sessions Judge Jammu SS Sarangal held the prosecution has failed to prove the motive behind the murder. In his 41- page judgment Principal Sessions Judge, after hearing both the sides and going through the statement of the witnesses, observed that prosecution has not been able to prove the motive behind the murder. It has also not come forward with any motive behind the murder. There is not even a whisper about the motive of accused behind this crime which is fatal for the prosecution thus the prosecution has failed to prove the guilt of the accused beyond any reasonable doubt and as such, benefit of doubt is given to the accused Multan Singh and is accordingly acquitted of murder charges. According to the prosecution on November 13, 2004 one Ragubir Singh resident of Marjali lodged a verbal report with police station Gharota stating therein that his younger brother Daryodhan Singh was missing since November 11, 2004. After great search his body was found in well and the death of deceased had taken place in suspicious circumstances. The police after registering a case started investigation and recorded the statement of the wife of the deceased who stated that on the said day in the evening when her husband returned to home Multan Singh a neighbourer took the deceased towards a well. After two-three hours when Multan Singh came back all alone she enquired about her husband but Multan Singh did not reply properly. On this, she become suspicious and started search for her husband, but all in vain. It was on November 13, 2004, the people found dead-body of the deceased in the well. After completion of investigation police presented challan against the accused Multan Singh and Mohan Singh u/s 302/34 RPC. However, accused Mohan Singh died during trial of the case. |
