Jammu, Aug17- Justice Mansoor Ahmed Mir of J&K High Court Jammu Wing in a petition challenging the attachment of AEE Rural Engineering Wing Sub-Division Banihal has stayed the operation of order dated August 7, 2009.
In a petition filed through Advocate Abhinav Sharma in which it has been submitted that the petitioner was posted as Incharge Assistant Executive Engineer Rural Engineering Wing Sub-Division Banihal, the respondents initiated some departmental enquiries on the basis of complaint, which came to be conducted against the officials, who were holding the post at the relevant time and not against the petitioner but despite that Secretary RDD J&K passed order No 171-RD of 2009 dated August 7, 2009 whereby petitioner came to be attached. The petitioner contended that the impugned order is punitive in nature and the illegal and malafide.
Justice Mir after issued notice to the State of J&K through Chief Secretary, MS Khan Secretary to Govt RDD, TN Pandita SE REW Ramban,. Sheikh Nazir Ahmed AC Development Ramban, Rashpal Singh JE and Director RDD Jammu returnable within four weeks and in the meanwhile subject to objections from the other side and till next date of hearing, the operation of impugned order dated August 7, 2009 is stayed. However, it is made clear that during the pendency of the writ petition, the direction shall come in the way of the respondents to effect transfer in the interest of administration, Court said. JNF
