| HC orders reinvestigation of Kishtwar murder case by CB | | | Early Times Report Jammu, Aug 19-- In the rarest of the rare cases, the Jammu and Kashmir High Court today ordered reinvestigation of murder case by the Crime Branch of the state. Justice Nirmal Singh, in the petition filed by alleged accused in a murder case of one Romesh Kumar of Kishtwar seeking investigation of the case through Crime Branch, observed that the brothers of the deceased have specifically pleaded that the police has not investigated the matter properly and have falsely implicated Babber Jan and Mohammed Ramzan in the case who are otherwise ready to cooperate with the investigation. Referring to a judgment of the Division Bench of the state High Court, Justice Singh disposed off the petition with a direction that the matter shall be reinvestigated by the Crime Branch of the State. The investigation shall be started within a period of 15 days of receipt of copy of this order. The investigation should be conducted by an officer not below the rank of Superintendent of Police. The officer concerned after conducting the investigation shall file its report before the Trial Court within a period of three months. Thereafter, Trial Court shall proceed further with the Trial in accordance with law, Justice Singh ordered. The objections filed in the case state that the deceased Romesh Kumar was having illicit relations with the sister of petitioner Babbar Jan, a surrendered militant. On this, the petitioner planned to commit murder of the deceased Romesh Kumar. On November 28, 2006 there was cricket match and when the deceased was returning to home after watching the cricket match, the petitioners Babber Jan and Mohammed Ramzan, who had hidden in near by bushes at Gothi Nallah, caught hold of deceased and Babbar Jan pressed the throat of the deceased as result of which he got killed. During the course of investigation the petitioner Babbar Jan had confessed that he had kept a rod in his cowshed which was used in hitting the deceased. The said rod was recovered at the instance of Babbar Jan. it is under these circumstances that both the petitioners have committed the murder of Romesh Kumar and there is no question of false implication as alleged by the brothers of the deceased.
