PSC’s 208.8 cut off mark objected, HC issues notice

Jammu, Aug 21: The Jammu and Kashmir High Court has issued notice to the Public Service Commission in a plea filed by some candidates of reserved categories questioning the fixed slab of 208.8 marks in preliminary examinations for being eligible to appear in the mains of J&K Combined Services Examination popularly known as Kashmir Administrative Services. The candidates alleged that the criterion fixed by the PSC is in complete contravention of set rules.
A Writ petition filed by the petitioners seeking quashment of notification PSC/Exam/2009/21 of July 31, 2009 whereby PSC has fixed 208.8 marks as minimum cut of marks for appearing in the main examination, Justice Hakim Imtiyaz Hussain of J&K High Court Jammu wing has issued notice to State and Public Service Commission which was accepted by Sr. Adv DC Raina appearing on behalf of PSC and directed to file objections by next date of hearing.
The petition filed by petitioners through Adv CS Gupta in which it has been submitted that the petitioners in pursuant to the notification issued by the Public Service Commission dated December 30, 2008, the petitioners who were fully eligible appeared in the entrance examination conducted by the PSC. The petitioners belong to ST, RBA Category and appeared against the 40 and 80 posts out of 398 posts reserved for ST and RBA Category. The 39000 candidates had appeared in the examination. It has been alleged that result declared by the PSC is neither 1/3 of the total candidates nor 25% of the candidates who have appeared in the preliminary examination is in violation of Rule 8(2) of SRO 387 dated December 1, 2008 and seeking quashment of SRO issued on July 31, 2009 with direction to respondent to reframe the result declared and include the name of the petitioners in the fresh notification.
