Pak militant gets four years imprisonment

Jammu, Aug 22- The alleged Pakistani militant arrested in 1995 in a much publicized war between the militants and the army at Charar-e-Sharief was today convicted and sentenced to four years imprisonment.
Presiding Officer TADA Court Jammu, after hearing both the sides, observed that as per the facts coming out accused is a Pakistani National who entered into India without proper and valid documents. He has admitted that he is a Pakistani National and does not want to lead any evidence in Defence. Keeping in view the facts and circumstances of the case, the accused Mohammed Shaifq Malik son of Imdadullah Malik of Faisalabad Pakistan is sentenced to imprisonment for a period of four years and fine of Rs 1000, the Court ordered.
According to the police case Mohammed Shafiq Malik a Pak militant, after crossing the international border entered Jammu and Kashmir without valid documents, indulged in terrorist activities. He was apprehended by the security forces when he along with other terrorists laid a siege of Charar-e-Sharief town and holed-up in holy shrine and Khankah. When the army and other paramilitary forces rushed to the spot and laid a cordon around the area, the militants resorted incriminate firing and explosions with the result the adjoining Khankah including buildings caught fire and in the said encounter. Some security personnel and civilians were injured and some died in the encounter. FIR was registered against the accused for various penal offences in Police Station Charar-e-Sharief Budgam.
Deputy Director Prosecution appearing for the state during the course of arguments said that evidence on record is clear that accused is a Pakistani National and has indulged in terrorists activities defined in the TADA Act. The accused along with other terrorists had razed the town to ashes. JNF
