Court rejects bail application of accused involved in rape case

Jammu, Aug 25- Special Mobile Magistrate Electricity Jammu MK Sharma today rejected the bail application of Rakha son of Ghulam Hussain of village Kharh Tehsil Jammu involved in a rape case.

After hearing Senior Prosecuting Officer DP Singh for the State and Advocate Ved Pal appearing for the accused, and also going through the police case, Special Mobile Magistrate observed that when a person is arrested or appears before the Court for the purpose of bail and if the offence in which the accused is involved is bailable, the bail is granted without much ado. However, in the present case the accused has been arrested u/s 376 (rape) which is non-bailable offence and is not punishable with death; however, the accusation against the accused is very serious. The accused is alleged to have committed rape upon his close relative in presence of minor son of the victim. The traumatic experience does not only affect the behaviour of the victim but the cognitive behaviour of minor son who was witness to the crime. The offence u/s 376 RPC is punishable with imprisonment for life or for ten years. The offences against the women are on the rise and any concession of bail to perpetrators of such like crimes leaves a bad impact on the general public. With these observations Court rejected the bail application of the accused

According to the police case on July 8, 2009 the prosecutrix along with her son was going to Village Mawa and the accused, who is related to her, also started going with the prosecutrix. On the way the accused tried to outrage the modesty of the prosecutrix and the prosecutrix requested the accused to refrain from doing so. However, on reaching an isolated place, the accused tied the son of the prosecutrix with a tree and committed rape upon her. The accused has been arrested and the investigation is in progress JNF.
