| SC breather to traders; Sept 7, 15 notifications operative | | | New Delhi, Sep 29 Traders facing sealing of unauthorised constructions in the capital today got an interim relief as the Supreme Court kept operational the Government's two controversial notifications allowing commercial activities in the residential areas pending its decision on their validity. However, the sealing will continue on the premises not covered by the September 7 and 15 notifications, the Court said while holding that those who have already given an undertaking to shift commercial activities from residential areas are exempted from the sealing drive till October 31 in view of the Dussehra and Diwali festivals.
Small traders in residential areas have been kept undisturbed with the court permitting them to continue with their commercial activity.
The Bench headed by Chief Justice Y K Sabharwal, however, restrained the Government from issuing any other notification without the leave of the court.
While giving breather to the traders covered under the two notifications, the Court directed them to give an undertaking by November 10 before the court-appointed Monitoring Committee headed by former bureaucrat Bhure Lal that the misuse will be stopped if the notifications were quashed.
"We direct that the said premises may not be sealed pending decision of these petitions on undertaking being filed before the Monitoring Committte on or before November 10, 2006 that the misusers shall be stopped as per the directions of this court if the Act is invalidated and/or the notification is quashed," the Bench, also comprising Justices C K Thakker and R V Raveenderan, said. |
