Court declines to convert case into murder instead of abetment to suicide

Jammu, Aug 28- The third Additional Sessions Judge Jammu RS Jain today dismissed the application filed by Special Public Prosecutor of State seeking alteration of charge framed against accused Captain Chaitanya Bhatwadaker, husband of deceased Mega Razdan, from abetment to suicide 306 to murder 302 RPC.
The Judge, after hearing Special Public Prosector PN Raina appearing for the State and Advocate Vishal Kapur appearing for the accused, observed that since framing of the charge no evidence has been adduced by the prosecution in support of its case. The prosecution in the present case wants an alteration of the charge on the same material on the basis of which charge was framed. It is settled principle of law that once the charge is framed, the same can only be altered provided new and further evidence on record is produced after framing of charge. To accept the application filed by the prosecution for alteration of the charge would be to review the order September 24, 2008 framing of charge which is impermissible under law. In view of the facts and circumstances of the case at this stage the application having no merit is dismissed.
According to the case accused Captain Chataniya Bhatwadaker and deceased Capt Mega Razdan, after completion of their training joined in the engineering unit and were married in the month of September, 2006 as they had love affairs. After one month of their marriage their matrimonial ran into rough weather and they started quarreling. Captain Chataniya Bhatwadaker was having an extra martial relationship with another girl namely Seema Kulkarni of Pune and was sending her SMS and also making calls to her in the night. This relationship created ruptures in the married life of both..It was alleged that Captain Mega Razdan had told this all to her parents and ultimately according to the case the accused abetted to commit suicide, which the Capt Mega Razdan committed suicide on July 1, 2007 at Kunjwani Army Quarters. On the complaint of Lt Col CB Parshad the police registered and case and started investigation and after completion of the investigation presented challan in the Court of law. Court on September 24, 2008 framed charges against Captain Chataniya Bhatwadaker u/s 306/498-A RPC. JNF
