| Two accused involved in adulterated Desi Ghee scam get bail | | | Early Times Report Jammu, Aug 28- In a much publicized adulteration case of Desi Ghee, Justice JP Singh of J&K High Court Jammu Wing today granted bail to Naresh Gupta and Vinod Kumar who are in police custody since June last. While granting bail to the accused, Justice Singh observed that during the course of consideration of these bail applications the State counsel conceded that no notification u/s 3 of EC Act has been issued in respect of Desi Ghee. The Investigating Officer appearing in the case stated that the petitioners were no more required to be interrogated and they stood remanded to the judicial custody. Considering the submissions of counsels for the parties and in view of the statement of the State Counsel that no notification u/s 3 of EC Act has been issued in respect of Desi Ghee, the question of the violation of the provisions of EC Act by the petitioners, entailing punishment u/s 7 of Act would be unnecessary, while considering petitioners plea for bail. There is no doubt that menace of adulteration in food stuff is on increase which requires attention of the law makers to take requisite steps. With these observations Justice Singh allowed both the bail applications and admitted them to bail on furnishing personal bond and surety bond to the tune of Rs 10,000 each to the satisfaction of Registrar Judicial of High Court Jammu Wing. The petitioners filed these bail applications in the State High Court seeking release on bail in FIR 182/2009 registered at Police Station Domana U/Ss 420/472 RPC r/w section 3/7 of Essential Commodities Act, after the rejection of their bail applications by the Principal Sessions Judge and Third Additional Sessions Judge Jammu. The case against the petitioners is that they were dealing in adulterated Desi Ghee indicating it to be of the brands available in the market, which actually, it was not. JNF
