Minister for Agriculture, Mr. Ghulam Hassan Mir, on behalf of the Minister for Labour and Employment, in reply to clubbed question of Mr. Mohammad Yousuf Taing, Mr. Murtaza Ahmed Khan, Mr. Mohammad Amin Bhat and Mr. Ali Mohammad Bhat informed the Legislative Council that as per the directions of the Hon’ble Supreme Court in 1996 the registration with the Employment Exchanges was held as not mandatory for obtaining Government job. He said in the light of this, all the un-employed youth do not register themselves with Employment Exchanges. He said that the Department does not have exact figures regarding educated or un-educated unemployed persons. However, the number of unemployed youth registered with various Employment Exchanges is 1.18 lakh. He said 36414 posts including 5176 gazetted posts are vacant in different departments up to June 2009. Of which 23853 posts including 4023 gazetted posts have been referred to recruiting agencies adding that all the recruitment agencies have been advised to fast track the selection process. He said 10,922 selections have been made by the recruiting agencies since January 2009.
He said the financial and administrative implications of providing sustenance allowance to un-employed educated youth would need to be examined in depth vis-à-vis the obtaining resources of the State to evolve a policy on this account. It is premature for the Government to make any commitment in this behalf at this juncture. He said it is not possible to provide government jobs to all the unemployed educated and professionally trained youth. However, several steps have been taken to address the unemployed problem, he added. He said that there is no ban on recruitment. However, the Government has prescribed the upper age limit for entry into government service for General category candidates as 37 yrs, for physically challenged candidates as 39 yrs, for member of SC/ST as 40yrs and for RBA/ALC candidates as 40 yrs. He said that in terms of the Government order No: 102-GAD of 2007 dated: 27-01-2007 the contractual appointees are also deemed to be in-service candidates so far as upper age limit is concerned, in case they apply to the recruiting agencies viz. PSC/SSB provided they subsist on the date of advertisement is issued. He said age is to be reckoned from Ist January of the year in which advertisement notice is issued by the Recruiting agency.
The Minister said again vide government order No: 1500-GAD of 2000 dated : 21-12-2000, the recruiting agency can entertain the application of the over-aged candidates, if such agency comes to a view, upon examination of the application and supportive documents that such a candidate is other-wise exceptionally qualified adding that if such a candidate makes it to selection on strength of his merit, the recruiting agency will recommend the relazxation in upper age limit to the appointing authority who in turn is required to take up it with the Chief Minister through Chief Secretary in coordination, he said.

The Minister also replied supplementaries raised by Mr. Abdul Gani Vakil, Syed Asgar Ali, Mr. Altaf Ahmad Wani, Syed Mohammad Rafiq Shah and Mr. Khalid Najeeb Suhrwardi.
