| DB stays Writ Court order regarding affiliation Pvt Engineering College | | | Early Times Report Jammu, Sept 07- The Jammu and Kashmir High Court today stayed the order of the writ court directing University of Jammu to consider the case of Tawi Education Trust for affiliation and allocations of students in accordance with the relevant rules for ensuing session 2009-10 and not for the session 2008-09 as the students if now allocated would not be able to cover the minimum attendance. The University being aggrieved of the order passed by the Writ Court filed an LPA through Adv WS Nargal in the State High Court which was decided by the Division Bench comprising Justice Nissar Ahmed Kakru and Justice Mohammed Yaqoob. DB after hearing Advocate WS Nargal appearing for the University observed that there is no denying that the direction against the University has been passed without hearing it. The DB further observed that inability of the University to entertain the application of the petitioner’s trust for the grant of affiliation was because of absence of the concurrence by the State Government prescribed by statutes and regulations governing the process of affiliation. The Bench accordingly stayed the operation of the directions of the writ court till next date of hearing In another LPA, the Division Bench directed the respondents to file objections by next date till then operation of impugned judgment to the extent it mandates consideration by the University to the petitioner for affiliation shall remained stayed. In view of the urgency expressed, the matter shall be listed on September 14, 2009 subject to availability of Bench, the DB ordered. JNF
