| Court acquits HM militant facing trial for hurling grenade on a bus | | | Early Times Report Jammu, Sept 08- Following police failure to prove its case against the accused, the third Additional Sessions Judge Jammu RS Jain today acquitted Mumtaz Ahmed son of Nazam Din resident of Gujjar Kothi Tehsil Reasi, a HM militant, facing trial for exploding grenade on a bus causing death of one and injures to several others. After hearing both the sides and going through the statement recorded by the witnesses and also submissions made by the counsels of both sides, the Judge observed that Perusing the testimonies of the prosecution witnesses examined by the prosecution, the Court held that none of the witnesses have deposed anything against accused Mumtaz Ahmed to show his involvement in the commission of offence with which he is charged. Accordingly accused Mumtaz Ahmed is acquitted from the charges leveled against him. According to the prosecution case on April 7, 2006 at Baradari Chowk Tehsil Reasi accused persons namely Mumtaz Ahmed and Anwar both real brothers, with intention to kill people, exploded a grenade on a bus resulting into death of a person and injuries to others. The accused, members of banned militant organization Hizbul Mujahidin, used to provide shelter to terrorists belonging to HM organization. The accused were charge-sheeted u/s 302/307/212/216/34 RPC and 3 PSSA and 7/27 Arms Act while the Court issued General Arrest of Warrants u/s 512 Cr PC against accused Anwar who was declared absconding.
