| HC stays operation of transfer order of a teacher | | | Early Times Report
Jammu, Sept 09- While issuing notice to the State and others returnable within four weeks, Justice Mohammed Yaqoob Mir of J&K High Court today stayed the operation of impugned transfer order dated August 31, 2009.
Raies Ahmed petitioner who was placed under suspension vide Government order dated August 31, 2009 for his unauthorized absence and alleged commission of irregularities in of mid-day meal scheme filed a petition in the High Court challenging the impugned order .
After hearing Advocate A M Malik appearing for the petitioner, Justice Mir observed that strong case is made out which warrants indulgence, hence until filing of objections the operation of order dated August 31, 2009 shall remain in abeyance.
The petitioner alleged that the impugned order is outcome of the enmity for wrecking vengeance at the behest of MLA Doda. This order has been issued on the communication of MLA Doda to CEO Doda on July 15, 2009. The petitioner was transferred on July 24, 2009 from Bagla to Shaja on an available vacancy. On July 29, 2009 in a surprise inspection conducted by Tehsildar, on the instruction of Additional Deputy Commissioner Doda, petitioner was found absent when according to the petitioner on the said day he had gone to ZEO office to submit the staff statement ..JNF
