| Cops involved in supplying ammunition to militants denied bail | | Facing trial under Enemy Agent Ordinance, other offences | | Early Times Report Jammu, Sept 10- Rejecting all the three bail applications filed by two cops and other alleged militants, the Principal Sessions Judge Jammu SS Sarangal observed that since accused are facing trial in heinous offences like 3 EAO, 7/25 Arms Act and other offences u/s 120-B, 409/109 RPC as such the accused do not deserve bail at this stage. The court held that all the offences are non-bailable and heinous in nature hence the bail applications are rejected at this stage. Public Prosecutor EA Tak appearing for the state submitted that accused being the agents of ISI of Pakistan have been indulging in subversive activities and actively working as enemy agents. There is likely hood of the accused tempering with the prosecution witnesses if they are admitted to bail at this stage and even accused will jump over the bail in case they are released. Nissar Ahmed Head Constable Incharge Malkhana Police Station Kishtwar and Mohammed Ashiq selection grade constable of the same police station and Mohammed Yousaf and Yasin both residents of Kathiar, Kishtwar and accused Mohammed Ibrahim a local militant had filed their bail applications. According to the prosecution case on July 29, 2006 Kishtwar Police received information that accused Mohammed Yousaf and Mohammed Yasin hatched a conspiracy with militants operating in Kathiar Banjwah area and Nissar Ahmed Head Constable Incharge Malkhana Police Station Kishtwar and Mohammed Ashiq selection grade constable and procured from them arms and ammunition for providing it to the banned militants’ organizations for causing disruptive activities in the State. Upon this information a case u/s 406/409/109/34 RPC 4/5/6 ESA and 3EAO and 7/25 Arms Act was registered and investigation started. On the same day police party headed by SHO P/S Kishtwar arrested Mohammed Yousaf and Mohammed Yasin near a bridge at Thathri and recovered one AK-47 rifle along with its magazine containing 30 live cartridges from the possession of accused and four live cartridge of a pistol. On the same day SHO recovered one Chinese grenade near Kuligad Bridge on the basis of disclosure statement of accused Mohammed Yousaf and one AK-47 rifle along with its magazine on the basis disclosure statement of accused Mohammed Yasin. During further investigation it was found that accused after having hatched a conspiracy with militants operating in the area including a Pak Militant namely Abu Jandal and a local militant Mohammed Ibrahim hatched further conspiracy with head constable and selection grade constable allegedly provided arms and ammunitions to accused militants which was earlier seized by the same police station.
