| Court acquits alleged militant as police fails to produce evidence | | | Early Times Report Jammu, Sept12- Acquitting accused militant from the charges leveled against him, the Third Additional Sessions Judge Jammu RS Jain observed that the police has failed to produce evidence to establish the case despite giving ample opportunities. After hearing both the sides Court held that the prosecution has been given ample opportunities to adduce its evidence and more so none of the prosecution witness have deposed anything against the accused to show his involvement in the commission of offence with which he is charged. The Court is of the view that the prosecution has failed to prove the guilt against the accused as such accused Abdul Majid son of Hussain Shah of Thanamandi Rajouri is acquitted from the charges leveled against him, the Judge ordered. While the Additional Public Prosecutor sought adjournment to adduce the evidence on next date of hearing, the counsel for accused submitted that on August 18, 2009 the prosecution was given last opportunity to adduce the evidence. He further submitted that accused is facing trial for the last so many years and ample opportunities have been given to the prosecution to adduce evidence as such evidence be closed. According to police on September 15, 1998 accused Abdul Majid along with Kalu (who died during the pendency of Trial) fired upon security personnel and threw a grenade on them resulting injuries to some of them. Accordingly a case was registered u/s 307 RPC and 3 PSSA and after completion of the case challan was presented in the court of competent jurisdiction. JNF
