31 AEEs seeking release of pay scales
HC directs respondents to seek approval from PSC within one month

Jammu, Sept 16- In a petition filed by 31 AEEs seeking direction to the respondents to release pay scales of AEs and AEEs with effect from 2001 and 2005 respectively, Justice Virender Singh of J&K High Court Jammu Wing today directed the respondents to take all effective steps for getting approval from PSC/DPC within one month. In case all this exercise is not done by PSC/DPC within the stipulated time period, the pay scales shall be released to the 31 petitioners on the same analogy as has been released in favour of Vinod Gupta and others, the HC ordered.
After hearing both the sides, Justice Singh held ‘the petition is formally admitted and disposed off at this stage itself with a direction to respondents to take all effective steps’.
Senior Advocate MK Bhardwaj, appearing for the petitioners, submitted that in case of other similarly situated persons the High Court, in a case titled Vinod Gupta and others, granted them the relief without there being any approval by the PSC/DPC. He further submitted that the pay-scales be released in favour of the present 31 petitioners also on the same analogy. He further submitted that in case of Vinod Gupta and others the matter has not been decided by the PSC/DPC till date and it is otherwise evident from the order dated April 4, 2009 in which it has been stated that the case of petitioners for relief is underway and the pay scales shall be released to them as asked for after regularization of their services approved by the PSC/DPC. On the other hand Senior Additional Advocate General SC Gupta was not in a position to controvert or admit this fact. He, however, stated that the matter has already been taken up with PSC/DPC and is in active process which is likely to be completed very shortly, may be within a month’s time. (JNF)
