HC quashes termination order, directs for enquiry

EARLY TIMES REPORT
Jammu, Sept 17- Quashing the impugned order of September 2, 2002 where under the petitioner was removed from service, Justice Mansoor Ahmed Mir of J&K High Court Jammu Wing today directed the respondents to conduct enquiry within three months from the date of this order is served. The period of over stay and the period from the date of removal from service till today shall be subject to the outcome of the enquiry, the Court ordered.
Petitioner challenged the order dated September 2, 2002 through Advocate Sheikh Altaf Hussain whereby the petitioner was removed from service for over staying on leave for three days with effect from May 2, 2002 to May 5, 2002. The counsel for the petitioner submitted that in the said order it is nowhere provided that the charge-sheet was framed and summary of allegations was served on the petitioner which is mandatory under the police rules.
