| Family members of adhoc employee entitled to compassionate appointment: HC | | | Early Times Report Jammu, Sept 29- Jammu and Kashmir High Court today held that the family member of an adhoc employee is entitled to appointment on compassionate ground under SRO 43 of 1994. In a landmark judgment Justice Sunil Hali, in a petition filed by Safia Begum, observed that if a person having status of an adhoc employee dies in harness, his family members can seek appointment on compassionate grounds in terms of SRO 43 of 1994. Allowing the petition, Justice Hali directed the respondents to consider the case of the petitioner for appointment on compassionate grounds strictly in terms of rules subject to her qualification and eligibility and complete the exercise within a period of three months Safia Begum in her petition, filed through Adv Surinder Kour, submitted that her husband was engaged as Pharmacist in the year 1991 on adhoc basis and continued till February 2003 when he died after a massive heart attack. She submitted that she sought appointment on compassionate ground under SRO 43 of 1994 and the case of the petitioner was recommended by the Block Medical Officer, Chief Medical Officer as well as Director Health Services but her case was rejected by the administrative department on the ground that her husband was not a permanent employee of the state Government and as such she cannot claim the benefit under SRO 43.JNF.
