| Defence official acquitted in disproportionate assets case | | | Early Times Report Jammu, Oct 05- After seven years of trial the Special Judge Anticorruption Jammu BL Bhat today acquitted Raj Kumar Bhagat then Senior Auditor in the office of Controller of Defence Accounts for possessing disproportionate assets to the tune of Rs 9 lakhs. The case was investigated by CBI. After hearing Senior Public Prosecutor SK Bhat appearing for the CBI and Advocate Surinder Kour appearing for the accused, Special Judge observed that the balance sheet provided at the trial appears to be based on sound footing, once their concerns are addressed the alleged disproportionate of assets slightly over Rs 9 lakhs is bound to be paid into significance and bring such figures within the purview of erroneous mathematical calculation more particular as the source of the basic deposit of FDRs/ KVS has not been proved with the result that with renewal of such deposits from time to time the amount has been multiplying. The defence evidence in this regard stands un-rebutted and the line of Defence adopted in case examination leads credence in the same. The probability raised evidence on record, in this regard preponderant and discharges the onus resting upon the accused. Viewed this the explanation offered by the accused is held to plausible and no case of being in possession of assets disproportionate to known source of income is made out against the accused as such the prosecution case fails and accused is acquitted of the charges. According to the CBI case accused Raj Kumar Bhagat then Senior Auditor in the office of CDA Jammu had amassed huge assets disproportionate to his known source of income, a case was registered and investigation started. After completion of the investigation challan was presented in the court of Special Judge Anticorruption against the accused. JNF
