Police remand extended by three days

Jammu, Oct 8: Even as the Special Investigation Team (SIT) today security a further three-day remand for the suspended and arrested Police officials –former SSP Manohar Singh, Inspector Sultan Mirza and Sub Inspector Satnam Singh -a local court today reserved order on the pre-arrest bail application of Choudhary Nagar Singh, Ujjagar Singh and Rakesh Singh in the Amandeep murder case.

Second Additional Sessions Jammu Vinod Chatterji Koul, after heaving both the sides in length and called the Case Diary file of Amandeep Singh murder case, reserved order on bail application.

Senior Advocate Mohammad Aslam Goni with Advocate Ashok Parihar appearing on behalf of the petitioner argued on the bail application on various grounds. Special Public Prosecutor and senior Advocate Sunil Sethi opposed the bail on the ground that the applicants are involved in a case registered of prevention of corruption and this court has no jurisdiction in this act which is a special act and triable by Special Court.

City Judge Mrs. Kusoom Pandita Jammu today granted three days police remand of arrested former SSP Manohar Singh, then SHO Sultan Mirza and SI Satnam Singh who were produced in the court in a tide security but not in handcuff, who are allegedly involved in destruction of evidence u/s 201 RPC. At this stage Adv PN Raina, DS Chouhan, OP Sharma appeared for the arrested police officers opposed extension of remand on various ground including that the SIT has failed to comply the legal procedure. Upon this City Judge Jammu Mrs. Kusoom Lata Pandita directed the SIT to produce the Case file on next date with page marked.

Meanwhile SIT produced the main murder accused Jatinder Singh alias Raja in the Court City Judge handcuffed for extension of judicial remand which was granted by the Court for 9 days.

In another development

Special Judge Anticorruption Jammu Mr. BL Bhat in a bail application filed by Advocate OP Sharma for release of Sultan Mohammad Mirza then SHO Gandhi Nagar has directed the Chief Prosecuting Officer to produce the report from the concerned Investigating Officer and the file objections.

In the bail application it has been submitted that applicant was arrested by Special Investigation Team constituted for the investigation case FIR NO 247/2009 registered with police station Gandhi Nagar u/s 302/34/201/120-B RPC r/w section 3/25 Indian Arms Act. That the applicant allegedly involved in the offence of u/s 201/120-B of RPC, Advocate OP Sharma during the course of argument submitted that offence for the alleged commission which applicant has been arrested being bailable and his continued detention amounts to “wrongful confinement”. He further submitted that when the investigation of case FIR 247/2009 of P/S Gandhi Nagar was going, another FIR No 275/2009 u/s 5(2) Prevention of corruption Act r/w 161/165 RPC was registered against he applicant along with the other police officers on September 30, 2009 and the case under the Prevention of Corruption Act on absolutely false and baseless grounds that the applicant along with others was responsible for the destruction of evidence in case of FIR 247/2009 with consideration of wrongful pecuniary gains that alleged fact of the destruction of the evidence for monitory considerations by some accused including the applicant was already a subject matter of investigation by the SIT though the offence u/s 5(2)-Z PC Act had not been added formally to list of offences under FIR NO 247/2009 and this it would be deemed in eyes of law that the applicant had already been arrested for the alleged commission of offence and denied that the applicant committed any offence that to take of an offence under prevention of corruption Act and prayed for grant of bail of the applicant.
