| Court awards two years imprisonment to tipper driver in accident case | | | Jammu, October, 01- Judicial Magistrate Kathua Mr. Sunil Sangra has awarded two years imprisonment and fine of Rs 2000/- to accused Omkar Nath s/o Bua Ditta r/o Rattana Chak Kathua, who was facing trail for the last five years for rash and negligent driving leading to an accident with a scooter. Due to the accident, the scooter driver and pillion rider got serious injuries and admitted to the hospital. While awarding sentence Judicial Magistrate after hearing Prosecuting Officer Anil Dev Singh appearing for the state and Advocate Balbir Singh appearing for the accused observed that the defense counsel failed to point out discrepancies from the evidence of the witnesses, which he wants to get explanation by cross-examining Investigating Officer. As such this Court came to conclusion by non-examination of IO, no prejudice has been caused to accused. With these observations Court awarded six months imprisonment u/s 279 and fine of Rs 1000/-, imprisonment for six months and Rs 500/-fine u/s 337 RPC and one year imprisonment u/s 338 RPC. Court ordered that all the punishment shouldl run concurrently. The accused who was present in the Court was sent to District Jail for serving punishment.
