Tender notice for supply of Labour challenged
HC restrains respondents from giving effect of notice

Jammu, Oct 10- Staying the operation of the tender notice dated September 11, 2009 issued by the Registrar SKAUST Jammu, Justice Virender Singh of Jammu and Kashmir High Court in a petition filed by Harishoor and 97 others appointed on contractual basis in SKUAST challenging the tender notice for supplying labourers and others today directed for filling reply to the main petition within a week’s time. The copy of this order shall be furnished to the counsel for the petitioners and list the case on October 15, 2009, the Court ordered.
During the course of arguments senior Advocate SS Lehar submitted that petitioners were appointed by the respondent University on contractual basis in different categories as, labourers, security guards, tube well operators, generator operators etc @ Rs 2100 per month. The services of the petitioners have been disengaged vide order dated September 17, 2009. Before terminating the services of the petitioners, the respondent’s University issued tender notice on September 11, 2009 for supply of labourers, security guards etc. Senior Advocate further argued that the services of the petitioners have been terminated without issuing any notice to them and without hearing them. The orders impugned are against the legal and fundamental rights of the petitioners and prayed for staying the order impugned dated September 17, 2009 whereby the petitioners were disengaged, besides the impugned tender notice issued by the Registrar of the University in the interest of justice.
In the meanwhile in a petition filed by Mohammed Shabir and hundred others, who were also disengaged by the SKAUST, Justice Singh ordered that this petition be heard along with petition NO 1734/2009 on October 17, 2009. In another petition filed by Basni Lal and 51 others who were working on contractual basis in the SKAUST and were disengaged on September 17, 2009, Court issued notice to University and others for filling objection within a week’s time and ordered that list this petition again on October 15, 2009.
