| SIT files report; CJM directs for filling report on Bukhari, Raj Singh case | | | Early Times Report Jammu, Oct 13- Following submission of report in three bail applications of suspended Police officers in the much publicized murder case of Amandeep Singh by the Special Investigation Team ,investigating the murder case, the Special Judge Anticorruption Jammu JR Kotwal, after perusing the report, adjourned the bail applications for October 15, 2009. SIT on the direction of Special Judge Anticorruption had filed report in the three bail applications filed by S Manohar Singh then SSP, Sultan Mirza then SHO and Satnam Singh then Sub-Inspector of Police Station Gandhi Nagar today. The report filed through Chief Prosecuting Officer Pawan Khajuria it has been submitted that during the investigation of FIR NO 247/2009 in the murder case of Amandeep Singh it has been found that two accused namely Jatinder Singh alias Raja son of Choudhary Nagar Singh and Royal Singh son of Manjit Singh fired on Amandeep Singh on August 29, 2009 at his residence 349 Shastri Nagar Jammu with criminal intention causing the death of Amandeep Singh on August 30, 2009. Accused Jatinder Singh was arrested on August 30, 2009 and Desi Katta (firearms) was recovered at his instance and later sent to FSL along with blood stained clothes and bullet extricated from the body of deceased for expert opinion. In order to get the FSL opinion the Investigating Team was perusing the case in FSL Jammu. During investigation it was found that Katta had been swapped and further an attempt was also made to swap the bullet in FSL Jammu by Sarwer Hussain Bukhari Ballistic Expert and Constable Raj Singh to swap the weapon of offence and bullet. A deep routed conspiracy was hatched by Nagar Singh, Ujjagar Singh and Rakesh Choudhary sons of Koula Ram residents of Raipur Satwari and Gandhi Nagar with S Manohar Singh then SSP Jammu, Inspector Sultan Mohd Mirza then SHO Gandhi Nagar and SI Satnam Singh of P/s Gandhi Nagar Jammu to save the accused Jatinder Singh from the clutches of law and heavy amount was exchanged in this regard. On strong suspicious Sarwer Hussain Bukhari and constable Raj Singh of FSL were questioned and it was found that they had a close nexus with the suspended police personnel and their role in swapping of Desi Katta and extricated bullet was established in consideration of huge amount of money. During investigation Rs 3.10 lakhs and Rs 40, 000 were recovered from Sarwer Bukhari and Raj Singh respectively at their instances. The money was provided by Rakesh Chouhary for swapping of extricated bullet so as to give favorable report of beneficiaries by misuse of their official position for pecuniary consideration. In this way Rakesh Choudhary at the behest of Nagar Singh and Ujjagar Singh abetted the commission of offence of offering bribe to Sarwer Hussain Bukhari and Raj Singh both along with above police personnel to commit criminal misconduct by misusing their official position by accepting illegal gratification for swapping the bullet and weapon of offence and requested for registration of case. The report further says that investigation by SIT is at the advanced stage and its report is valuable in terms of the allegations incorporated in a case FIR No 275/2009 u/s 5(2) PC Act 2006 r/w sections 161/165-A RPC. Both the FIRs are co-related with each other. The complaint lodged by SIT for registration of case has been elucidated out of FIR 247/2009 P/s Gandhi Nagar. In the report it has been further submitted that during the course of investigation questioning of alleged accused would be vital and they are bent upon to take refuge of protection of law to which they are not entitled to as the recovery of bribe amount indicates strong assertion with respect to their involvement in the deal having struck. The secrutiny of the records, bank accounts and allied evidence would suggest further course of action. In the meanwhile, Principal Sessions Judge adjourned the bail application filed in FIR NO 247/2009 as the SIT has not submitted its report. The matter was adjourned by the Principal Sessions Judge B L Bhat till tomorrow. However, CJM Jammu has directed the investigating agency to file objections in the bail applications of Sarwer Hussain Bukhari and Constable Raj Singh by tomorrow along with the report regarding seizure of a vehicle by the SIT.
