| CJM awards one year imprisonment to thief | | | Early Times Report Jammu, Oct 14- Chief Judicial Magistrate Jammu YP Bourney awarded one year imprisonment and fine of Rs 2000 to a thief with the order that fine if realized shall be paid to the complainant as compensation. CJM Jammu, after hearing CPO Pawan Khajuria and accused present in person, observed that from the evidence on record, it has been proved beyond doubt that accused along with another broke open the locks of the house of complainant by taking advantage of his absence with intention to commit theft but he could not succeed being spotted by one Vikram Singh and other inhabitants of the locality. However, it is clearly shown from the evidence on record that accused Vijay Kumar made abortive attempt to commit theft by breaking open the house of Ramesh Marwa at the mid of day and hence the commission of offence u/s 454 r/w 511 RPC by the accused is made out and he is convicted accordingly. While awarding sentence the CJM further observed that accused has faced long trial of about 8 years. However, he has not expressed any remorse for his conduct during trial and it was perchance that his attempt failed due to timely intervention of Vikram Singh. The accused does not deserve to be let off by extending the benefit of probation of offenders act. With these observations Court awarded one year imprisonment and fine of Rs 2000 to the accused.
