| HC issues notice to Union of India | | IB employee’s transfer kept in abeyance | | Early Times Report Jammu, Oct 14- In a petition filed by Joginder Singh employee of Intelligence Bureau challenging frequent transfer orders, Justice Virender Singh of J&K High Court Jammu Wing has ordered that transfer order of the petitioner dated September 11, 2009 shall remain in abeyance. Justice Singh also issued Notice to Union of India through Secretary Home, Director Intelligence Bureau, Joint Director Subsidiary Intelligence Bureau and Assistant Director (Establishment) SIB Jammu returnable within three weeks and ordered that the impugned order No 693 dated September 11, 2009 shall remain in abeyance. In the petition in which Advocate Surinder Kour appeared for the petitioner submitted that after putting more than 16 years of service at Srinagar, the petitioner was transferred to Jammu from where he was transferred to Sunderbani and from Sunderbani he was transferred to Kalakote. The petitioner made a representation for cancelling the transfer order on compassionate ground which includes the ailment of his parents. Subsequently the said order was cancelled in June 2009. Just after three months of that order Assistant Director (Establishment) Subsidiary Intelligence Bureau has passed the impugned order picking the petitioner singly for transferring him from Sunderbani to Rajouri. Advocate Surinder Kour further submitted that once the transfer of the petitioner from Kalakote was cancelled on compassionate ground; there was no justification for transferring him to Rajouri, a very hard station just within three months and further submitted that even otherwise respondent Assistant Director is not competent authority to pass the order.
