AMANDEEP MURDER CASE
Nagar, bros proclaimed offenders
10/16/2009 12:24:59 AM
Analysis confirms cellphone network among tainted cops,
FSL officials, beneficiaries; IGP Gupta reviews SIT progress
Jammu, Oct 15: Even as the National Conference President and Union Energy Minister Dr Farooq Abdullah set a damage controlling ‘48-hour deadline’, apparently to change course of public debate on his party legislators’ meeting with the tainted cops in jail, to nab the key conspirators in Amandeep murder evidence destruction case, the Police have declared them as proclaimed offenders.

On second day of review meetings with the Special Investigation Team (SIT) convened by the Inspector General of Jammu Police Ashok Gupta, the Chowdhary trio –Nagar Singh, Ujjagar Singh and Rakesh Singh –were declared as proclaimed offenders and decision was taken to massively up the already launched hunt to nab them.

Sources told Early Times that Gupta had inviting Director Prosecution Fazal Karim from Srinagar who participated in the meeting to review progress of the evidence destruction angle in Amandeep murder case. Sources said that the meetings convened by IGP Jammu also completed at call analysis of various cell phones used by the Police officials, FSL officials and the beneficiaries. Sources privy to the meeting told Early Times that the call analysis confirmed conversations between the Chowdhary trio, Police and FSL officials which has confirmed beyond any doubt a strong connection between them.

Earlier in the day the Union Energy Minister Dr Farooq set for Police a 48-hour deadline to nab Nagar Singh, father of Jatinder Singh, the key accused in Amandeep Singh murder case. Farooq’s ‘deadline’ comes days after two of his party legislators met the imprisoned and suspended SSP Manohar Singh in jail. There has been whisper campaign in the town since then questioning the logic of their meeting with tainted cops. Farooq’s statement was, therefore, being seen by many as changing the public mood. Sources said that an internal inquiry has been ordered by the NC president to look into conduct of party legislators in meeting the jailed cops.

Meanwhile, the Principal Sessions Judge Jammu BL Bhatt today adjourned for tomorrow the bail applications of former SSP Manohar Singh, Inspector Sultan Mirza and Sub Inspector Satnam Singh after the Special Investigation Team filed objections as per earlier objections of the court.

In the report a sensational disclosure was made about the telephonic conversation between the tainted cops, the Chowdhary brothers and FSL officials. The SIT pleaded before the Court that release of tainted cops was fraught with the risk of hampering investigation.

According to report as per the record of BSNL & Airtel, it was alleged that before the murder of Amandeep Singh, the police officers and employees of FSL and Chowdhary brothers has a link and it is not out of rule that the accused police officers are alleged involved in the case of murder. It is said that the investigation is going and the reality will come out after the arrest of the Chowdhary brothers.

In the objections filed through Special Public Prosecutor Senior Advocate Sunil Sethi that the petitioners prima-facie involved in heinous offence of fudging of vital evidence in murder case where they in criminal conspiracy with the other police officials and also the civilian had replaced the weapon of offence thereby trying to weaken the case of prosecution and to give benefit to the accused in the murder case. The crime committed by the petitioners is highly deplorable and has tried to pollute the stream of justice. In case any leniency is shown to the petitioners, the faith of people in criminal justice system will be severally eroded. Such persons are required to be dealt with sternly and without showing any discretionary relaxation. The petitioner being police officers knows of the ways of the investigation and limitation of investigation procedure and as such despite the fact has been subject to sustained interrogation. The petitioners have succeeded in not the disclosing the information about the conspiracy which was hatched between them involved in fudging the very vital evidence. However the SIT team is successful in obtaining vital and conclusive evidence to unveil conspiracy. The petitioners are prima-facie involved in a commission of offence u/s 201/409/120-B RPC r/w section 3/25 Arms Act.

In the objection it has been further submitted and vehemently denied that the petitioners are arrested in bailable offence. The petitioners being involved in non-bailable offence cannot claim bail as a matter of right. The mode in which the discretion can be exercised by the Courts in such like cases has been well defined by the Supreme Court of India and the case of the petitioners does not fall in any of such case. In the given facts and circumstances of the case the petitioners are not entitled to bail and the bail applications deserves to be dismissed out rightly.
