| Court acquits accused facing trial in NDPS Act | | | Early Times Report Jammu, Oct 18 Acquitting Manjeet Singh son of Kartar Singh of Nawashare Punjab, who was facing trial under NDPS Act for possessing 50 kilogram of Bukhi, the 3rd Additional Sessions Judge Jammu RS Jain has held that the prosecution has failed to prove the guilt against the accused beyond reasonable doubt by content and clear evidence. The Judge further observed that the prosecution witnesses contradicts each other on material points thus makes their testimony unreliable and there is non-observance of the provisions of the NDPS Act by the investigating agency. The accused Manjeet Singh is acquitted from the charges leveled against him, the Court ordered. According to the prosecution case on September 30, 2007 at BC Road Jammu, during the patrol duty, the police party found accused carrying a bedroll coming towards the outer gate of the Bus-Stand and on seeing the police he tried to runaway. However, the police succeeded in apprehending the accused and on search recovered 50 kg Bukki from his possession. A case was registered u/s 15/16 NDPS Act against the accused and after completion of investigation challan was presented in the Court. JNF
