| 1994 DWs regularization rules applicable to Corporation: HC | | | Early Times Report
Jammu, Oct 19- In a landmark judgment the Jammu and Kashmir High Court today held that Reservation Rules notified vide SRO 64 of 1994 relating to regularization of Daily Wagers in Government Departments having completed seven years of service are also applicable to the daily rated workers in the Corporations including the Jammu and Kashmir State Handloom Development Corporation.
Justice J P Singh while disposing off a petition of a daily rated worker of the Handloom Development Corporation observed that the reservation rules, notified vide SRO 64 of 1994 as applied by the Government order No 26-F of 1994 are also applicable to the Corporations, which includes J&K State Handloom Development Corporation, thus entitles the petitioner, who has completed more than seven years continues period of working as daily rated worker in the corporation, because of the consequences flowing from the Labour Court’s award to regularization in the Corporation service, in terms of rules r/w provisions of the Government orders. The corporation is therefore under an obligation to consider the petitioner’s case for regularization under the regularization rules and for grant of all consequential benefits pursuant to his regularization. The Court directed the respondent to ensure compliance within three months. JNF
