| CJM issues proclamation against Nagar, brothers | | | Early Times Report Jammu, Oct 21: The Chief Judicial Magistrate Jammu YP Bourney has issued proclamation under section 87 CrPC against Chowdhary Nagar Singh and his brothers Rakesh and Uajjagar Singh in Amandeep Singh murder case. The trio has been asked to surrender before the Court or the Special Investigation Team before November 20. The proclamation notice said all efforts of Special Investigation Team to secure the presence of the accused persons failed to materialize and consequently warrants of their arrests were obtained, however, despite Strenuous efforts of SIT and raids at several places within an outside the state, the possible hideouts of accused, but same could not be executed. Chief Prosecuting Officer Mr. Pawan Khajuria appearing for the SIT submitted before the Court that accused after acquiring the knowledge of issuance of warrants have disappeared and are hiding themselves in evade the execution of process of law. CPO also placed on record and the warrants and reports recorded together with several reports of raids conducted at several places in search of the accused. Upon this CJM Mr. YP Bourney said that from the material placed on record, it is shown to the satisfaction of the Court that accused have gone underground and are hiding themselves for avoiding the execution of process of law (warrants). A proclamation is therefore, order to be issued calling upon all the three accused persons to surrender before this Court or Incharge SIT within 30 days from the date of its publication, failing which appropriate orders as are deemed necessary in the circumstances shall be passed. Court further ordered that proclamation shall in addition to the ordinary mode as prescribed u/s 87 CrPC, be published in Govt Gazettes. With these observations Court disposed of the application. Meanwhile Sr. Adv Sunil Sethi also appointed as Special Public Prosecutor for the case of corruption charges against then SSP and ors.
